1. Scope
This Privacy Policy describes how Wam Investments LLC, d/b/a Caliber Counsel ("Company," "we," "us"), collects, uses, and discloses information in connection with calibercounsel.com (the "Site") and the Caliber Counsel membership program. This Policy does not apply to information handled by a Contracting Attorney once you are referred to one — that relationship is governed separately by attorney-client confidentiality and applicable rules of professional conduct, not by this Policy.
2. Information We Collect
(a) Contact and inquiry information you submit through the Site's contact and partner-inquiry forms: name, email address, and message content.
(b) Membership enrollment information collected through our payment processor (Stripe) at signup: name, billing address, phone number, and email address.
(c) Payment information: processed directly by Stripe; Company does not itself store full payment card numbers.
(d) Communications you send us directly, such as emails to counsel@calibercounsel.com.
(e) Automatically, through the Meta Pixel installed on the Site: this technology collects information about your browsing activity on the Site (such as pages visited and actions taken, like starting checkout), your device and browser, and, where available, an IP address or hashed identifiers that Meta may match to a Meta account. We use this information to measure the effectiveness of our advertising, to build and deliver ads on Facebook and Instagram, and to reach people with similar characteristics to our visitors (“lookalike audiences”). Meta's use of this information is governed by Meta's own data policy, in addition to this Policy. You can control ad personalization through your Facebook and Instagram account settings, and through browser-level tools described in Section 10.
3. How We Use Information
(a) To administer your membership, including matching you with a Contracting Attorney upon report of a Covered Incident.
(b) To process billing and manage your subscription through Stripe.
(c) To send you transactional communications, including your welcome email and any notices about your membership.
(d) To respond to inquiries submitted through the Site.
(e) To improve the Site and our membership offerings.
4. How We Share Information
We do not sell personal information. We share information only as follows:
(a) With Contracting Attorneys, as necessary to provide legal services following a report of a Covered Incident.
(b) With service providers who process information on our behalf, including Stripe (payments), Resend (transactional email), and Formspree (contact form processing) — each acting under their own privacy and security practices.
(c) As required by law, subpoena, or legal process.
(d) In connection with a merger, acquisition, or sale of assets, subject to standard confidentiality protections.
5. Attorney-Client Privilege
Information you share directly with a Contracting Attorney in the course of representation may be protected by attorney-client privilege. Administrative information you provide to Company for membership purposes (such as billing details) is not privileged and is handled under this Policy, not as privileged communication. If you are ever uncertain whether a specific communication is protected, ask your Contracting Attorney directly.
6. Data Security
We use commercially reasonable safeguards to protect information in our possession. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Data Retention
We retain membership and billing information for as long as your membership is active and for a reasonable period afterward as necessary for legal, tax, and recordkeeping purposes. We retain general inquiry submissions for 12 months unless a longer period is required by law.
8. Your Rights
Most comprehensive state privacy laws give consumers some version of the following rights: to know what personal information we hold about you, to correct inaccurate information, to request deletion, to obtain a portable copy of your data, to opt out of targeted advertising and the sale of personal information, and to not be discriminated against for exercising these rights. To exercise any of these rights, contact us at counsel@calibercounsel.com. We will verify your request and respond within the time required by applicable law.
If you are a resident of one of the following states, that state's privacy law applies to your personal information as described above: California (California Consumer Privacy Act, as amended by the California Privacy Rights Act), Colorado (Colorado Privacy Act), Connecticut (Connecticut Data Privacy Act), Delaware (Delaware Personal Data Privacy Act), Florida (Florida Digital Bill of Rights), Indiana (Indiana Consumer Data Protection Act), Iowa (Iowa Consumer Data Protection Act), Kentucky (Kentucky Consumer Data Protection Act), Maryland (Maryland Online Data Privacy Act), Minnesota (Minnesota Consumer Data Privacy Act), Montana (Montana Consumer Data Privacy Act), Nebraska (Nebraska Data Privacy Act), New Hampshire (New Hampshire Data Privacy Act), New Jersey (New Jersey Data Privacy Act), Oregon (Oregon Consumer Privacy Act), Rhode Island (Rhode Island Data Transparency and Privacy Protection Act), Tennessee (Tennessee Information Protection Act), Texas (Texas Data Privacy and Security Act), Utah (Utah Consumer Privacy Act), and Virginia (Virginia Consumer Data Protection Act).
California residents specifically have the right to bring a private lawsuit for certain data breaches under the CCPA, in addition to the rights above.
9. Children's Privacy
The Site and membership program are not directed to individuals under 18. We do not knowingly collect personal information from children.
10. Cookies and Tracking Technologies
